Welcome to The Rib Cartel. These Terms & Conditions govern your use of our website and the purchase of products through our online store.

By accessing, browsing, or placing an order through this website, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use the website or place an order.

These Terms & Conditions are subject to applicable South African legislation, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Protection of Personal Information Act 4 of 2013 ("POPIA"), and other applicable laws.

Nothing in these Terms & Conditions is intended to exclude, restrict, or limit any right or protection that a consumer has under South African law where such exclusion, restriction, or limitation is not legally permitted.

2. Products

We sell meat, meat products, biltong, dry wors, prepared products, and other food products as displayed on our website.

We take reasonable care to ensure that product descriptions, photographs, weights, prices, and other information are accurate. However, photographs are provided for illustrative purposes and the appearance of an individual product may vary.

Where products are sold by weight, the final weight may vary slightly from the displayed or selected quantity due to the nature of cutting, preparation, packaging, and portioning.

Where a product is subject to availability, this will be indicated where reasonably possible.


3. Product Availability

All orders are subject to stock availability.

If a product becomes unavailable after an order has been placed, we will contact the customer where reasonably possible to discuss an alternative, amended order, or refund where applicable.

If we cannot fulfil an order, any amount already paid for the unavailable product will be refunded in accordance with applicable law.


4. Prices

All prices displayed on the website are in South African Rand (ZAR).

Prices may be changed from time to time without prior notice.

The applicable price for an order will generally be the price displayed when the order is confirmed.

We take reasonable steps to prevent pricing errors. If an obvious pricing or product description error occurs, we may contact the customer before fulfilling the order to confirm whether the customer wishes to proceed.

If an affected order cannot reasonably be fulfilled, the customer will be entitled to cancel the affected order and any amount paid for that order will be refunded.


5. Placing an Order

To place an order, the customer must provide the information requested during checkout and select the required products, quantities, delivery details, and payment method.

Before submitting an order, customers should carefully check:

  • The products selected;
  • Quantities;
  • Prices;
  • Delivery address;
  • Contact information; and
  • Any other order information.

Customers will be given an opportunity to review and correct applicable errors before finally submitting the order.

An order is not considered accepted solely because it has been submitted. Order acceptance is subject to product availability and successful payment processing.

An order confirmation will be provided electronically where applicable.


6. Payment

Payment must be made using the payment methods made available through the website.

We may use third-party payment service providers to process payments. Payment information may therefore be processed by the relevant payment provider in accordance with its applicable terms and privacy policies.

We do not knowingly retain complete card details where these are processed directly by an appropriately secured third-party payment provider.

We reserve the right to delay processing an order until payment has been successfully confirmed.


7. Delivery

We deliver to selected areas as specified on the website.

Delivery availability may depend on the customer's location, delivery schedule, product availability, and operational capacity.

Orders placed before 10:00 AM may qualify for same-day local delivery, subject to availability and delivery capacity.

Orders placed after 10:00 AM will generally be scheduled for the next available delivery day.

Delivery times are estimates and are not guaranteed.

Traffic, weather, vehicle problems, operational circumstances, unusually high order volumes, or other circumstances outside our reasonable control may cause delays.

Where we become aware of a significant delivery delay, we will endeavour to communicate this to the customer where reasonably possible.


8. Delivery Address

Customers are responsible for ensuring that the delivery address and contact details supplied during checkout are accurate and complete.

The customer must ensure that an appropriate person is available to receive the order.

If delivery cannot be completed because an incorrect address was supplied, nobody is available to receive the order, access to the property is unavailable, or another circumstance attributable to the customer prevents delivery, additional delivery arrangements or charges may apply where reasonably appropriate and lawful.

Because our products are perishable, customers should arrange for the order to be received promptly and placed under appropriate refrigeration or storage conditions.


9. Perishable Products

Many of our products are perishable food items and require appropriate handling and storage.

Customers are responsible for following any storage, refrigeration, preparation, or use-by instructions supplied with the products.

Once products have been properly delivered and accepted, customers are responsible for appropriate storage and handling.

This does not affect any rights the customer may have where products were defective, unsafe, damaged, incorrectly supplied, or otherwise failed to comply with applicable legal requirements at the time of delivery.


10. Returns, Defective Products and Consumer Rights

Because our products include perishable food items, we generally cannot accept returns merely because a customer has changed their mind or no longer wants the product after delivery.

This does not exclude or limit any statutory rights available to consumers.

Where goods are defective, unsafe, damaged, incorrectly supplied, or otherwise fail to meet applicable requirements, the customer's rights will be dealt with in accordance with applicable South African consumer law.

Our separate Returns & Refund Policy provides further information regarding complaints, refunds, replacements, and the handling of perishable products.


11. Complaints

Customers should report any problem with an order as soon as reasonably possible, preferably within 24 hours of delivery where the issue relates to freshness, condition, damage, incorrect products, or another problem that may be difficult to assess later.

Customers may be requested to provide photographs, packaging information, order details, or other reasonable evidence to assist with investigating a complaint.

A request for evidence does not remove any statutory consumer rights.


12. Refunds

Where a refund is required, it will generally be processed using the original payment method where reasonably possible.

The timing of a refund may depend on the payment provider or financial institution involved.

Where a consumer has a statutory right to a particular remedy, that right will not be restricted by this agreement.


13. Promotions and Specials

Promotional offers, discounts, specials, coupons, and other promotional campaigns may be subject to additional terms.

Unless expressly stated otherwise, promotions cannot be exchanged for cash and may not be combined with other offers.

We reserve the right to correct genuine errors in promotional pricing or information.

No promotion will be interpreted as limiting a consumer's statutory rights.


14. Website Information

We endeavour to keep the website accurate and operational but do not guarantee that the website will always be uninterrupted, error-free, or completely up to date.

We may modify, suspend, or discontinue parts of the website where reasonably necessary.

Nothing in this section excludes liability that cannot lawfully be excluded under South African law.


15. Intellectual Property

Unless otherwise indicated, content appearing on this website, including logos, photographs, graphics, text, product descriptions, branding, and other materials, belongs to The Rib Cartel or is used with permission.

No content may be copied, reproduced, modified, distributed, or commercially exploited without appropriate permission, except where permitted by law.

Personal information collected through the website will be processed in accordance with applicable South African privacy legislation, including POPIA.

18. Limitation of Liability

Nothing in these Terms & Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.

Subject to applicable law, we will not be responsible for losses caused by circumstances outside our reasonable control, including interruptions to telecommunications, payment systems, internet services, traffic, severe weather, or other unforeseen events.

Nothing in this clause limits statutory rights relating to defective, unsafe, or incorrectly supplied goods.

We may update these Terms & Conditions from time to time.

The version applicable to an order will generally be the version available at the time the order is placed, unless otherwise required by law.

The current version will be published on the website.


20. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and any applicable consumer dispute-resolution mechanisms.

CHECKOUT TERMS

1. Orders

Orders are subject to product availability and successful payment.

If an item is unavailable, payment cannot be processed, or an obvious pricing or product information error occurs, we may contact you before fulfilling the affected order. Where an order cannot be fulfilled and payment has already been received, the applicable amount will be refunded.

2. Same-Day Delivery

Orders placed before 10:00 AM may qualify for same-day local delivery, subject to delivery area, stock availability, and delivery capacity.

Orders placed after 10:00 AM will generally be scheduled for the next available delivery day.

Delivery times are estimates and may be affected by traffic, weather, operational requirements, or unforeseen circumstances.

3. Delivery

Customers must provide a complete and accurate delivery address and ensure that someone is available to receive the order.

Perishable products should be refrigerated or stored appropriately immediately after delivery.

This does not affect any statutory rights relating to goods that were defective, unsafe, damaged, or incorrectly supplied.

4. Perishable Products

Because our products are perishable food items, we generally cannot accept returns simply because a customer changes their mind after delivery.

5. Complaints

Please report any concerns as soon as reasonably possible, preferably within 24 hours of delivery, particularly where the issue concerns freshness, condition, damage, or an incorrect product.

Photographs or other reasonable evidence may be requested to assist with the assessment.
